01. Mad Art Terms and Conditions of Use

These Terms and Conditions of Use apply to www.madart.com.au and cover Mad Art Services Pty. Ltd. (hereinafter referred to as "Mad Art") any related firm, company or person, and any person or company acting on it's behalf. These Terms and Conditions Of Use are supplied to you upon your acceptance without modification and you are responsible for reviewing these Terms & Conditions of Use as Mad Art reserves the right to change these at any time. Your initial and continued use of this website is your agreement to all such Terms & Conditions of Use. Any verbal or email authorisation by you will be considered as you have read and agreed with these Terms & Conditions of Use.

Ownership

Mad Art and www.madart.com.au is owned and operated by Mad Art Services Pty. Ltd. ABN 84 126 075 438, Suite 1, Level 11, 118 Queen Street, Melbourne VIC Australia 3000.

Quotations

All quotes are valid for 30 days. Prices maybe subject to change if requirements differ from what has been specified in a quote or if there are additional requests.

Workflow Procedure

  1. Accept Quote: If you decide to proceed with a quote, you should email Mad Art with your acceptance stating the Quote number.
  2. Payment: Make the payment as per Quotation Terms and Conditions.
  3. Creative Briefing: When payment goes through one of our consultants will get in contact with you to discuss the creative brief.
  4. Time frame: Our design consultants will inform you of the time frames involved. The turn around time for logo design is 5 working days from design brief to the presentation of the initial concept.
  5. Additional Changes: If there are additional revisions to what you've been quoted, they will be invoiced upon completion of the work. This includes additional concepts and revisions including author's corrections and additional consultation time if required.
  6. Final Design: We will deliver the final design once we receive your payment of additional charges if any.

Payment Terms

  • Clients are required to pay price as per quotation Terms and Conditions prior to commencement of work
  • Payment can be made by direct credit or credit card (3% card fee apply - please inform us in advance).
  • Additional charges if any, will be communicated during the design process and billed at completion of work. These will need to be paid prior to final delivery of work.
  • 14 day payment term only available to Contract Clients
  • All printing requests require full payment prior to print production
  • All intellectual property and copyrights remain with Mad Art until the work is paid in full.

Contract Clients

  • All invoices have a 14 days payment term and interest may be applied to overdue invoices.
  • Interest is charged at 9% per day from the payment due date.
  • Consultant's timesheets are submitted via email with every invoice detailing Job number, billable hours and breakdown of tasks involved.
  • Mad Art reserves the right to change the hourly rate. We will give 20 working days notice to Contract Clients in writing prior to applying a new rate.
  • $44 inc. GST Minimum Charge applies.
  • Contract Clients agree to pay for all time spent at the offered hourly rate on services including but not limited to internal and external project meetings, traveling, client support, supplier and material sourcing, design, copywriting, finished art and mock-up. Other materials such as supplied file on CDs, colour proofs and postage are charged additionally.
  • Contract Clients will pay for all time spent at the offered hourly rate on a project even if they/ their company decides to cancel the project or not using the work in the end.

Our Fees

  • Design concepts and authors corrections are charged @ $77 per hour inc. GST.
  • We have a Minimum Charge of $44 inc. GST that applies to all tasks under 30 minutes. Any work over 30 minutes will be charged at our hourly rate.
  • Unless specified, the following items will be charged additionally if required. Copywriting, mock-ups, photography, traveling, final files distribution to multiple venues, supply of other file formats, postages, in-house colour proof ($5.50 inc. GST per A4 for internal used only), off-set colour proof, proof checking, retrieval of files, supply files on CD and meeting time.
  • Web hosting is payable yearly as an up front fee. You can terminate web hosting at any time however termination does not entitle you to a refund.

Artwork Files

Mad Art supplies design artwork as high resolution print ready PDF and logos as Illustrator.EPS files.

It is company policy that we do not provide working artwork files unless it has been discussed in advance and agreed in writing by one of our managers. Customers may purchase their stationary or any other artwork if need be.

Images, logos provided to Mad Art

By providing materials to Mad Art for use in a design, you warrant and represent that you own or otherwise control all of the rights to this material. This includes, but is not limited to, designs, logos, names, images, photos and/or other design material.

No warranties

This website is provided "as is" without any representations or warranties, express or implied. Mad Art makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Mad Art does not warrant that:

  • this website will be constantly available, or available at all; or
  • the information on this website is complete, true, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind.
